Banta. <br />Dwis~on Director <br />On February 25, 1992, the Division conducted an inspection of the above named <br />operation as part of our review of your application to convert yo r present <br />Limited Operations 110(2) permit to a Regular Operations 112 perm t. During <br />that inspection we found that you are apparently mining north of nd outside <br />your permit boundary. <br />Therefore, we have reason to believe that you are operating in violation of <br />your Permit No. M-86-159 and the Law and have scheduled this matt r before the <br />Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the March 25-26, 1992, Board <br />meeting for consideration of a possible violation, cease and desi t order, <br />corrective action, and civil penalty. The hearing will be held i Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or s soon <br />thereafter as the matter can be considered and you will have the pportunity <br />to be represented and heard. <br />If the Board finds a violation at this hearing, it may issue a ce se and <br />desist order, assess a civil penalty in the amount of $50 to $20 per day for <br />each day of violation or order the permit be suspended, modified r revoked. <br />In addition it may set the matter for consideration of forfeiture of the <br />financial warranty at a subsequent hearing. <br />~m"Tr_A_F' CQLORADO _ <br />III IIIIIIIIIIIII III OF.COr0 <br />
