Permit M82-121 <br />Dear Mr. Squire: <br />dlwslon of Minerals ~ i~er~~e9Y <br />Your inspection report of 5130/96, under the section concerning problems and <br />con,?ctive actions, requires that Mid-Continent "post an additional $6,213 finanaal <br />warranty by July 7, 1996.' <br />As you know, we are attempting to resolve our dispute with the Bureau of Land <br />Management (BLM) over the ownership of the previously mined materials so as to <br />allow for resumption of operation at the Mid-Continent Quarry without having to await <br />the decision of the Interior Board of Land Appeals (IBLA), before whom an appeal of <br />this issue is now pending. A substantial factor in that proposed'settlement would <br />be a provision which would allow Mid-Continent to post the additional bond, <br />notwithstanding the bankruptcy. <br />If this dispute can be resolved through such an agreement the IBLA appeal will be <br />withdrawn;rf not, then the appeal will go forward to hearing and the matter will be <br />decided by IBLA or a court of law. <br />Attached is the letter we have sent BLM outlining our proposal as to the basis for a <br />settlement. We are hopeful they will agree to it, and we pn then proceed with the <br />steps outlined to obtain the funds necessary to provide the additional finanaal <br />warranty, as required by DMG.
