The TDN wa <br />by the Division on December 16, 1992. On December 24, <br />Thomas Ehmett of your office acknowledged a request by th <br />for an extension of time to respond to the TDN, due to th <br />season and vacation schedules of staff involved with the <br />the TDN. Therefore, this letter contains the Division's <br />to item 1 of 2 in the TDN. Long <br />Drvis~on Director <br />Geology's <br />s received <br />1992, Mr. <br />e Division <br />e holidays <br />issues in <br />response <br />forwarded <br />n of this <br />Item 1 of the TDN cites an alleged violation of Rules 4.05.6 and <br />4.05.9 for failure to properly design and certify impoundments. <br />The sewage ponds at the Cameo Mine and two incised sumps at the <br />reclaimed North Decline area are cited. <br />Designs for the sewage ponds were not previously included in the <br />mine permit. This was an oversight on the part of the operator and <br />the DMG. Designs and certifications have been submitted to the <br />Division and are now included in the Roadside permit. Since the <br />alleged violation does not exist at this time, the Division is not <br />taking enforcement action in regard to the sewage ponds.
