Long <br />Division Director <br />The Notice of Violation CV-97-021 was issued on November 20, 1997 for failure to maintain <br />mine records at a site neaz the mine. A current certificate and quarterly pond inspection reports <br />from the quarter prior to the inspection were not available for public review. <br />On January 29, 1998, an Assessment Conference was held at 1313 Sherman Street in Denver. <br />Mr. Kent Gorham, of the Division of Minerals and Geology, presented testimony and <br />documentation regarding the inspections of October 22, 1997 and November 19, 1997. A copy <br />of the insurance certificate and updated sediment pond and waste pile inspection report was not <br />on file, as required. <br />The Proposed civil penalty for NOV CV-97-021 was: <br />History $0.00 <br />Seriousness $100.00 <br />Fault $250.00 <br />Number of Days Penalty Assessed <br />Good Faith <br />$0.00 <br />Total Civil Penalty Proposed by the Assessment Officer was $350.00 <br />Mr. AI Weaver, of Energy Fuels Mining Company, discussed various minor problems which <br />resulted in the required reports not being maintained, as required, for this time period. <br />After heazing this testimony and considering the evidence presented, I have come to the <br />following conclusions: <br />HIS[OrY <br />No penalty is appropriate for history. <br />Seriousness <br />I concur that the violation occurred as noted by the Division and that $100.00 is appropriate for <br />this administrative violation.. <br />
