<br />2.06.5(2) <br />(iii) Approval of this permit application will <br />constitute appropriate state environmental agency approval. <br />(e) The owner of the surface on which the two ventilation <br />facilities are constructed is the United States Government (BLM). <br />The land was occupied under the terms of lease D-052504 until the <br />lease was relinquished in 1985 or 1986. The surface disturbance <br />associated with the partially reclaimed ventilation facilities are <br />now authorized by BLM right-of-way COC-41183. The necessary land <br />owner approval required under this section is presented by a letter <br />dated May 25, 1994 from the BLM to Somerset Mining Company. The <br />approval letter follows as page 2.06-5i. <br />The Bear Canyon B Seam degas site is owned by the <br />Operator. Therefore, the surface land owner for the degas site <br />hereby requests that the variance to approximate original contour <br />be granted. <br />(f) The requirements of 4.27.4 will be met as follows: <br />(1) The highwalls will be backfilled and graded as shown <br />on the cross-sections on pages 2.06-6, 7 & 8. <br />(2) The watershed will be improved as described in <br />2.06.5(2)(d). <br />(3) Land above the highwall will not be disturbed. <br />(4) The land owners are the United States of America and <br />Somerset Mining Company, see section 2.06.5(e). <br />(5) The operations will be conducted in full compliance <br />with the terms of a permit issued under 2.06.5. <br />(6) The areas for which a variance is requested are <br />existing and no further spoil material will be placed. <br />(g) All requirements of the Act will be met by the applicant. <br />o ~~ <br />2.o6-s 10~ s <br />Rev. 2:05-27-94 <br />
