ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby finds the <br />Operator in violation of the permit terms, Section 34-32.5-116(4)(1) and (j) of the Act, <br />Construction Materials Rule 3.1.5(3) and the temporary sediment control plan, specifically for <br />failing to protect azeas outside of the affected lands from slides and damage and failing to <br />stabilize affected lands to control erosion.
