Long
d/ ~~ Division Director
RE: Technical Re/vision to AM-01, Thomas Pit'Permit No. M-1976-020.
Dear Mr. Potter:v
On March 7, 2002, DMG received a Technical Revision to the Amendment application
(AM-01) for the Thomas Pit. The revision included revised pages 14, 15, 16, 17 and
maps C-2 and C-6. Submitted documents verify that copy of the revised pages and maps
were also submitted to the La Plata County Clerk and Recorders Office on the same day
the revision was submitted to DMG. Therefore, the Technical Revision to AM-01 has
been filed in accordance with Rule 1.8.1.
The March 7, 2002 revision to AM-01 appears to have no substantial changes to AM-01,
appears to have only a minor effect upon the proposed reclamation plan and does not
alter any of the terms contained in the notice that was published in the newspaper or
mailed to the owners of the affected and adjacent lands. Therefore, pursuant to Rule
1.1(49) and 1.6.6, the original public notice remains current and the applicant shall not be
required to re-publish or re-notice for the March 7, 2002 revision to AM-01.
Pursuant to Rule 1.8.1(6) and 1.8.4(2-, DMG finds that the original decision date for AM-
01 need not be extended as a result of the March 7, 2002 revision. Decision date for
AM-01 remains at May 16, 2002.
DMG is reviewing AM-01 and its recent revision. Adequacy issues, resulting from DMG
review, wilt follow under separate mailing.
Sinter/re~~ly,
Wallace H.
