A small area exemption had been granted temporarily so that
sediment pond designs could be revised. The operator failed to submit revised
designs by the specified deadline.
History - No notices of Violation have been issued during the past 12 months
which are not currently under administrative review.
$ 0.00
Seriousness - During this time of year very little runoff occurs. The
operator had also taken measures to contain all runoff. Therefore damage is
not likely to occur (value of 2). The duration that damage could have
occurred is medium in length (value of 3). The extent of damage should it
occur would be small (value of 2).
Total amount is therefore $328.00
Fault - The operator had been temporarily granted a small area exemption from
se3~ment ponds with a deadline for submitting designs to bring the area into
compliance. This deadline was extended twice. However, the required designs
were not submitted by the deadline. Therefore the operator exhibited a lack
of diligence or reasonable care.
$ 750.00
/th
Doc.
