Sadler, being under oath and over the age <br />of twenty-one (21) years, state upon my oath as follows: <br />1, I am a Plaintiff in the above-captioned civil <br />action. <br />2. The affected lands included in the proposed mining <br />operation of Oren R. Spillers ir. its permit application to the <br />Colorado Mined Land Reclamation Board is within 200 feet of my <br />residence, which is located in La Plata County, Colorado. <br />3. We have owned the residence adjacent to the propos <br />gravel pit since approximately May, 1978, and lived in the house <br />for twn years prior to that time. <br />4, Unlicensed gravel extraction operations have been <br />conducted off and on at the site of the proposed operations for a <br />number of years. <br />5. Since the commencement of extraction operations, <br />our house has developed stress cracks and we know of no other <br />cause for the cracks and other structural problems in our resi- <br />dente other than the gravel extraction operations. <br />6.
