This NOV was issued for a spill of coal processing fines from the Foidel Creek <br />Mine into Foidel Creek and the mine's Sedimentation Pond E. <br />The NOV has three remaining abatement steps: Steps 9b, 10, and 11. Twentymile Coal Company has <br />requested extensions of the deadlines of these steps (letter attached). The new deadlines would be at <br />dates beyond 90 days from the September 19, 2006 NOV issuance date. <br />The deadline for NOV Abatement Step 9b, which requires the permittee to "remove coal fines <br />accumulation from north pond area and dispose of coal fines in existing coal refuse area", would be <br />extended from December 4, 2006 to January 31, 2007, so as to allow the coal fines to freeze and to <br />thereby improve their handling ability. <br />The deadline for NOV Abatement Step 10, which requires the permittee to "submit as-built (as-repaired) <br />construction drawings for the cleaned Sedimentation Pond E, with a demonstration of adequacy for <br />treatment of surface inflows (process flows and surface)", would be extended from December 11, 2006 <br />to February 9, 2007. <br />The deadline for NOV Abatement Step 11, which requires the permittee to "report, in writing, <br />completion of the Foidel Creek clean-up to the Division, CDPHE-WQCD, CDOW, and USAGE", <br />would be extended from December 11, 2006 to Februazy 9, 2007. <br />The Coal Program finds that the Twentymile Coal Company request complies with the requirements of <br />Rule 5.03.2(2)(c)(iii) of the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining (9/14/2005) regarding extensions of abatement deadlines for periods greater than 90 days from <br />the date of the issuance of a Notice of Violation.
