She will remove Seneca from the Board Agenda. <br />I understand your concerns with the NOV. In all honesty [h ou9h, the Division is evaluating whether we can allow <br />'minimal disturbance' areas within the permit area. There is no statutory or regulatory tlefinition. It is a concept we <br />approved at II-W to allow Seneca to use existing natural drainages to convey run-off from the reclaimed disturbed area <br />in the upper par[ of the drainage area to the sediment ponds in the undisturbetl valley below. The desi9nati on was not <br />intended to authorize additional disturbance resulting from failure of designetl structures. <br />For several years, the Neck Pi[ has keen a challenging location d[ the mine but hopefully as reclamation progresses the <br />area will stabilize.
