INSPECTION REPORT <br />DATE: March 23, 1993 <br />MINE: New Elk <br />PERMIT NO.: C-81-012 <br />COMPANY: Wyoming Fuels Company <br />10250 Highway 12 <br />Weston, Colorado 81091 <br />719-868-2761 <br />THE MINE IS CURRENTLY BEING OPERATED BY: <br />Basin Resources, Inc. <br />19300 Highway 12 <br />Weston, Colorado 8i09i <br />719-868-2761 <br />This inspection was initiated by the inspection being <br />conducted at the Golden Eagle Mine which is owned by the same <br />permittee. <br />During a review cf the ownership and control information whicYi <br />is tl:e same °or bcth mines it was determined that the New Elk <br />Mine was not in compliance with the Colorado Regulations nor <br />was the Golden Eagle Mine. Further document review indicated <br />that both the New Elk and the Golden Eagle mines had been <br />purchased by Enr_ech, Inc. and were being operated under the <br />name of Basin Resources, Inc. It was also determined that the <br />transfer of the permits and the new ownership had not bee:. <br />approved as required by the Colorado Regulations. <br />The change of ownership at the mine occurred in June of 1991. <br />The mine continued to operate and in May of 1992 an <br />application was submitted to transfer the permit to Basin <br />Resources, Inc. The Colorado Secretary of State approved the <br />name change from Wyoming Fuel Company to Basin Resources, Inc. <br />on March 2, 1992. Since a complete ownership change of the <br />mine occurred in June of 1991 the mine should not have been <br />allowed to operate until approval was granted for the transfer <br />of the permit by the Division of Minerals and Geology. The <br />application for transfer had not been approved as of the date <br />of this inspection, the mine is still in operation. Due to <br />3 <br />
