COIV ERT <br />SPECIAL COUNSEL <br />Re: Nielsons Incorporated <br />Dear Miss Jory: <br />Confirming our several telephone conversations of yesterday <br />and today, I would appreciate your confirming, in writing, our <br />understanding of those operations of Nielsons Incorporated which <br />are permissible on their gravel pit properties identified as <br />follows: <br />(1) As to the Grace Pit for which a permit was issued on an initial <br />tract of 34 acres, it is permissible for Nielsons Incorporated <br />to carry on within that 34 acre tract, any and all operations <br />which were appropriate to be performed under the permit as issued. <br />However, as to the area outside the initial 34 acre tract, <br />Nielsons Incorporated is not to perform any production work or <br />other operations until a revised permit application has been <br />filed and your approval has been obtained therefor. <br />(2) As to the Fedinec Pit which is used for rip rap (large size <br />blasted or fractured rock), it is permissible for Nielsons <br />Incorporated to use a bulldozer to push together in piles rip <br />rap which previously has been blasted loose in the pit and is <br />now lying on the floor of the pit as it fell from the blasting. <br />After dozing this rock into piles the same may be loaded onto <br />trucks and hauled out of the pit. However, Nielsons Incorporated <br />is not to conduct further blasting operations and is not to con- <br />duct further excavation or removal of new rock now undisturbed <br />and in place in the pit. <br />
