e~ <br />Attachment to Notice of Violation No. C-97-002 <br />NATURE OF VIOLATION: <br />Failure to construct the refuse pile as required by the approved permit application package and the <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. Energy <br />Fuels Coal, Inc. has not adhered to the restriction for a maximum lift thickness of 24", nor has the <br />refuse been compacted to 90% relative density. <br />Failure to provide, in the quarterly inspection reports, information to verify compliance with the <br />approved refuse placement plan. Specifically, the reports fail to state observed lift thickness and to <br />identify the number of compaction tests and their locations. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Submit a complete application for a technical revision to the Southfield Mine permit which <br />demonstrates that the refuse pile has the required minimum factor of safety of 1.5, and <br />incorporates the findings of the December 1996 TerraMatrix report into the permit <br />application package. <br />2. Obtain approval of the revision from DMG. <br />
