ORDER <br />Based on the above findings of fact and conclusions of law, the Board orders that Respondent shall: <br />A) Cease and desist from any further mining activities outside of the permit area, except for the <br />purpose of reclaiming the unauthorized disturbed areas, including removing waste rock and <br />product; <br />B) No later than August 23, 2002, the Respondent shall obtain the Division's approval fora 110 <br />amendment to revise the permit boundary of Lykins Gulch to include the affected land. <br />Concurrently, the Respondent shall request a release of sufficient undisNrbed or fully reclaimed <br />acreage within the approved permit area so that the total number of permitted acres does not <br />exceed 9.9 acres; <br />C) Pay a penalty of $100.00 per day for each day during which the violation occurred, for a total of <br />$4,100.00, except that all but $250.00 shall be suspended provided that the Respondent <br />complies with all corrective action set forth in this order. <br />DATED this ~~ day of ~'~~7~ , 2002. <br />FORT ORADO MINED LAND RECLAMATION BOARD <br />Ronald W.
