Hard Rock Paving and Redi-Mix, Inc. shall CEASE AND DESIST from further <br />disturbance, except for reclamation, of the area outside the approved permit boundaries AFTER <br />MAY 26, 1999, unless it submits a completed 112 permit conversion application by that date. Hard <br />Rock Paving and Redi-Mix, [nc. shall CEASE AND DESIST from further disturbance, except for <br />reclamation, of the area outside the approved permit boundaries AFTER AUGUST 26, 1999, unless <br />it secures an approved l 12 permit by that date. <br />3. Hard Rock Paving and Redi-Mix, Inc. shall comply with the following <br />CORRECTIVE ACTION: submit a conversion application Co convert the current Limited Impact 110 <br />permit to a Regular 112 permit which must include at a minimum all the disturbed areas within and <br />outside the existing approved permit area. The completed conversion application must be submitted <br />to the Division of Ivlinerals and Geology by May 26, 1999, and [he applicant must secure an <br />approved 1 l2 permit by August 26, 1999. In addition. Hard Rock Paving and Redi-Mix, Inc. shall <br />submit an interim reclamation bond in the amount of $55,000.00 by April 26, 1999. <br />4. Hard Rock Paving and Redi-Mix, Inc. is hereby assessed a CIVIL PENALTY of <br />$1,000.00 per day for 64 days of violation totaling $64,000.00, pursuant to Section 34-32.5-123(2), <br />C.R.S., and $303.44 for 8 hours of Division staff time at $37.93/hour pursuant to Section 34-32.5- <br />123(4). The total civil penalty is $64,303.44. Of the civil penalty, all but $15,303.44 is suspended <br />pending compliance with the corrective action outlined above. The un-suspended portion of the <br />Civil Penalty shall be paid by August 26, 1999. In the event that Hard Rock Paving and Redi- <br />Miz, Inc. does not comply with the corrective action, the entire civil penalty of $64,303.44 shall <br />become due. <br />The rights and obligations of recipients of a Notice of Violation/Cease and Desist Order are <br />described in the Colorado Land Reclamation AcC for the Extraction of Construction Materials, <br />Sections 34-32.5-101 et se ., Colorado Revised Statutes. <br />Nothing contained herein, particularly those portions requiring certain acts to be performed <br />within a certain time, shall be construed as a permit or license to engage in any prospecting or <br />mining operations within the State of Colorado. <br />Dated thi~ day of March, 1999 <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />FOR THE BOARD: <br />BY: <br />MICHAEL D ctor <br />Division of Minerals and Geology <br />M.bse\pmm~Bwrd Ordenlml7-197 MV99061.~c5 doc <br />
