The NOV was written as <br />"Failure to conduct second quarter, 1997 pond inspections as required by Rule <br />4.05.6(13)." With regard to sediment pond inspections, Rule 4.05.6(13) states: <br />"All sedimentation ponds shall be examined by n qualified registered <br />professional engineer or other yuulifred individuals under their direction. <br />The professional engineer or individual shall be experienced in the <br />c•onstrzrction of sedimentation ponds. Ponds shall be inspected for <br />s[ruc•tural weakness, erosion, and other hazardous conditions. The report <br />shall also include the level of the sediment in the pond and any other <br />reyrrired maintenance of the structure. These inspections shall be made <br />r•egulnrly during construction, upon completion of construction, and at a <br />minimum, on u y:rarterly basis thereafter. The report shall be retairTed at <br />or near the mine site and a copy of the report promptly submitted m the <br />Division on a yuarlerly or annucr! basis, as required by the Division. by a <br />registered professional engineer" <br />CYCC feels that the requirements of this rule were met for the second quarter; however, <br />the report forms were not completed nor on file at the time of the DMG inspection due to <br />an oversight. The following information is provided with regard to NOV CV-97-012. <br />Each of the ponds associated with [he NOV are visited on a weekly basis [o collect <br />samples as required by NPDES permit CO-0027154. Visual inspections with regard to <br />any structural problems, erosion, or hazardous conditions would be noted and repairs <br />scheduled for the pond, if necessary.
