%~ .

Mr. Robert H. Hagen -2-
March 15, 1984
An interesting note is that I raised this Issue during the OSM inspector
training seminar 1n Beckley, Hest Virginia. I was concerned technically about
when 1t was preferred management, 1n terms of impact to the soil, to leave the
topsoil 1n place rather than remove tt. OSM instructors Indicated that 1f the
area was not going to be disturbed, i.e., overburden 1s not going to be
removed, then topsoil does not have to be stripped. Apparently, that 1s the
policy to the East.
In a letter of December 2, 1983, the Division had indicated to Terror Creek
Company that topsoil salvage would not be required to the 1-acre equipment
storage area.
For the reasons outlined above, the Division feels that Terror Creek Company
is not 1n violation and proposes no further action.
SincErel
I
~d R. Ban a `
oal Supervisor
FRB/mmt
cc: Mr. Rick Chilton
Doc. No. 0087
