%~ . <br /> <br />Mr. Robert H. Hagen -2- <br />March 15, 1984 <br />An interesting note is that I raised this Issue during the OSM inspector <br />training seminar 1n Beckley, Hest Virginia. I was concerned technically about <br />when 1t was preferred management, 1n terms of impact to the soil, to leave the <br />topsoil 1n place rather than remove tt. OSM instructors Indicated that 1f the <br />area was not going to be disturbed, i.e., overburden 1s not going to be <br />removed, then topsoil does not have to be stripped. Apparently, that 1s the <br />policy to the East. <br />In a letter of December 2, 1983, the Division had indicated to Terror Creek <br />Company that topsoil salvage would not be required to the 1-acre equipment <br />storage area. <br />For the reasons outlined above, the Division feels that Terror Creek Company <br />is not 1n violation and proposes no further action. <br />SincErel <br />I <br />~d R.
