<br />The mined area will be reclaimed to cropland or pasture as it is mined out, and consistent with the State <br />Mined Land Reclamation Board approved reclamation plan. The project is also approved fora „ <br />residential use that is accessory to the operation of the mine. The site plan shows 4.39 acres set-aside for <br />the residential use, and for support structures for the associated with the residen[ial use and For the <br />storage of equipment for the mine. In addition, the applicant can operate a batch plant, with the <br />limitations subject to the conditions of approval. <br />3. Residual Land Restrictions, The Russell Gravel Pit does not contain any residual land. <br />4. Conditloos of Approval Applicant agrees that the following conditions listed in the Findings and <br />Resolution for initial approval of this development remain to be completed and/or wntinue to apply: <br />A. Operation of the Russell Grovel Pit Special Review shall 6e as specified in the representations of <br />the applicant and in the information contained in file k01-21396, unless modified by these ~' I <br />conditions of approval. <br />B. The operator shall provide the Lorimer County Planning Deparmtent a copy of their annual report to <br />Ote State that details overall compliance with the stomtwater managemant plan and n copy of the <br />annual report required by the State Mined Land Reclamation Boazd (MLRB). <br />C. The approval of the Russell Pit Spacial Review 00-Zt396 shall be null end void if, at any time after <br />the data of approval by [he Board of County Commissioners, the subject mining operation ., <br />substantially ceases for any period oF3 consecutive years. <br />D. Annual production shell not exceed 48, 000 tons. If the operator intends to increase the amount of <br />material removed at the site above 24,000 tons annually, the operator must submit a modified site <br />plan, update all applicable State permits, update their traliic impact report and pay the increased <br />County Capital Transportation Expansion Fee. <br />E. The Applicam shalt obtain all required State and/or Federal permits (including the State Air <br />Emissions Permit or exemption letter, the State Stormwater Discharge Permit, and the State Section <br />I12 Reclamaton Permit. The applicant shall provide copies of permits or authotiaations to the <br />Planning Department for the file within tS0 days of their approval from the Slate. The permits shall <br />reflect the yearly maximum tonnage as approved by Ole Board of County Commissioners. The <br />appHcaat must also obtain a Lorimer County access permit for the residential use, and pay the <br />Transportation Capital Expansion Fee as determined by the County Engineer within 60 days of their <br />approval, unless an appeal to this fee is approved by the Board of County Commissioners. <br />F. The quarry and processing operations shell comply with tiro requirements of the Ordinance <br />Concerning Noise Levels in Unincorporated Latimer County (Ordinance No. 97-3). <br />G. A]I disturbed areas, including haul roads, stockpiles and processing areas shall be graded se that <br />stormwater is directed to the on-site holding ponds. <br />H.
