This Notice of Violation was <br />issued 9/24/91 for failure to eliminate highwalls at the Fruits <br />no. 1 bench. Step 1 of the abatement process has been fulfilled <br />with the submittal of an application for a reclamation permit on <br />March 31, 1992 as required by Mined Land Reclamation Board <br />Settlement Agreement of March 24, 1992. Step 2 of the abatement <br />process is underway as final permit application review is <br />proceeding with the Division. As final a proposed decision has not <br />yet been issued by the Division the time extension for abatement of <br />this NOV shall be December 19, 1992. Be reminded that American <br />Shield Coal Company may contest the facts of NOV C-91-024 before <br />the Mine Land Reclamation Board within 30 days of issuance of the <br />reclamation permit. <br />If there are any questions concerning this extension or in regards <br />to any other matters, please contact me. <br />Sincerely, <br />Janet H.
