Collins. <br />This data might indicate that runoff had occurred for several days <br />preceding the inspection and may have continued for several more days had <br />the problem not been identified by the State inspector and promptly <br />abated. <br />3. Extent of Damage - The extent of damage is primarily unknown. No <br />damage occurred at the clogged culvert at the waste rock pile, or at the <br />spillway channel adjacent to tthe breaker building because runoff did not <br />occur in these areas. Where runoff was breaching the ditch at the <br />cross-over culvert on the access road, the extent of damage could not be <br />assessed due to snow cover. It is certain that the runoff breaching the <br />ditch caused some rills. However, the full extent of the damage cannot <br />be assessed until all the snow cover has melted. Whether this runoff <br />actually reached the North Fork of the Gunnison River is also unknown, <br />since snow cover and ice prevented observations. However, the area where <br />the breach occurred is very close to the river. <br />Based on the above three categories, the Division judges the Seriousness <br />of the violation to be moderate. The proposed penalty for this category <br />is 50% of the maximum penalty allowed of $1,150.00 <br />50X x $1,750.00 <br />Seriousness Total: $875.00 <br />
