After reviewing the materials with staff we <br />have determined the proposed amendment request filed with MLRD is beyond the scope <br />of what Boulder County has recognized through the issuance of building permits and <br />existing state mining permits. <br />The Boulder Cotmty regulations recognize subsurface mining at its current levels or <br />allow for expansion up to what a state mining permit allows as of June 10, 1997. <br />Article 4-508(E)(5)(b) Any existing subsurface mining operation may continue at its <br />current level, or the mining activity may expand up to the levels approved in its existing <br />state mining permit issued on or before June 1Q, 1997, or must have been lawfully <br />established prior to state mining permit requirements and have operated since January 1, <br />1987. <br />According to the application amendment the permitted area will be increased by 6.14 <br />acres, including lands that were previously not permitted. The Cash Mine increase to <br />2.76 acres from the current permitted area of 2.26 acres. The Who Do Mine Area will <br />increase from 1.43 permitted acres to 2.42 acres. The Mount Royale area is currently not <br />included in the permit area and contains 4.65 acres. Boulder County views the inclusion <br />of these previously un-permitted areas, under the state permit, as an increase in the level <br />of use and as such requires review under Article 4-508(E) of the Boulder County Land <br />Use Code. <br />The specific level of use will determine which applicable review process is necessary. <br />Limited impact special review is required when the use: <br />A) has a total production level of between 20,000 and up to, but not including, 70,000 tons <br />per year; or <br />B) generates between 7 and up to, but not including, 20 average daily truck trips, as defined <br />by the Institute of Transportation Engineers (with trucks defined as vehicles of greater <br />than 26,000 pounds gross vehicle weight). <br />Special use review is required when the use: <br />ram rolaya Ben aea4man wn roar <br />County Commcslaner CaunN Corrvniesioner County Cammiuioner <br /> <br />
