., <br />Pond designs were reviewed at the mine site and DMG office. The pond designs do not <br />include opening the dewatering gate during a precipitation event to be in compliance with <br />the rules and to meet the effluent limitations described in the NPDES permit. Mine water <br />discharges are designed to exit the primary riser. When the dewatering gate was opened, <br />the pond was not allowed to function as designed. The dewatering gate is four feet lower <br />than the elevation of the primary riser. <br />The NPDES permit states that all manual dewatering devices must meet TSS and total iron <br />limitations. From the water analysis noted above, it is evident that the ponds were not <br />allowed to function as designed to effect compliance with Rule 4.05.2(7). <br />Please let me know if you have any questions. <br />c:\wp51\colowyo\960411 <br />
