DMG addressed this non-compliance <br />by issuing a NOV. <br />BACKFILLING AND GRADING <br />Contemporaneous Reclamation--Reclamation of the mine <br />has been timely with the exception of the facilities <br />area. Although some grade work has been done this <br />area remains pretty much as it was during mining. <br />Several structures have been left in place of which no <br />demonstration has been made as to how they support the <br />post mining land use of grazing and wildlife. DMG had <br />previously identified deficiencies in the reclamation <br />plan for the mine and required that they be addressed. <br />Sun Coal addressed those deficiencies but not to the <br />satisfaction of DMG. DMG has notified Sun Coal of <br />remaining deficiencies in the reclamation plan and has <br />instructed Sun Coal to address these deficiencies by <br />July 1, 1994. AFO expressed concerns with the <br />reclamation of the facilities during the inspection of <br />the mine and agreed to allow DMG aartl additional time <br />(1 week) to pursue action which would result in the <br />proper reclamation of the site. AFO agrees with the <br />deficiencies and the action taken by DMG at this time. <br />AFO will monitor the progress of thA facilities <br />reclamation to .insure final resolution of the concerns <br />stated above.- - - -- - - - - <br />Approximate original Contour--Although a Phase I bond <br />release has been granted on the upper reclaimed area, <br />it appears that one location in the southwest part of <br />the mine is not back to its approximate original <br />contour. This was obvious due to a cut of <br />approximately 5 feet remaining and the fact that the <br />area did not blend with the surrounding terrain. DMG <br />should review the history of the mine to determine why <br />this area is not back to the approximate original <br />contour. <br />REVEGETATION: Some areas of the mine support adequate <br />vegetation while others has sparse vegetation. It appears <br />there may be a problem with topsoil depth in those areas of <br />poor vegetation. <br />Other: It was discovered that numerous mine documents have not <br />been provided to AFO. DMG will instruct Sun Coal to provide <br />these and future documents to AFO. <br />6 <br />
