Banta, <br />Division Director <br />DATE: May 15, 1991 <br />T0: Coal Mine Permittees ~~ <br />FROM: Steven Rennet:- :~ <br />RE: Combination Spillways (Rule 4.05.61 <br />The Colorado Rules and Regulations for Coal Mining (4.05.61 have been modified <br />to reflect recent changes in the federal regulations. As you may know, the <br />state petitioned fora grandfather clause in the federal regulations, but was <br />rejected. The new regulations require that principal and emergency spillways <br />be separated, unless they are configured as an armored open channel. <br />A number of ponds which currently route primary and emergency discharges <br />through a single, enclosed spillway are impacted by this Rule change. Ponds <br />with this type of spillway will need to be reconfigured to meet this new <br />criteria. <br />Affected permittees will need to submit technical revisions to their permits <br />which incorporate these design changes. The revision should meet the design <br />criteria of Rule 4.05.6. Revisions should be submitted such that <br />on-the-ground construction is completed by no later than September 1, 1991. <br />We regard this date as a final implementation deadline, barring serious, <br />unforseen circumstances. <br />If you have questions or comments regarding either appropriate design <br />standards or the technical revision process, please feel free to contact the <br />lead specialist for your mine. <br />SGR/yjb <br />cc: David Cole, CMA <br />MLRD Coal Staff <br />5111E <br />
