* • III IIIIIIIIIIIII III • <br /> 999 <br /> BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> File No. M-81-302 <br /> IN THE MATTER OF WESTERN MOBILE-DEEPE FARM PIT-AMENDMENT 002 <br /> FINAL DECISION AND ORDER <br /> The Formal Public Hearing on Amendment 002, as proposed by Western Mobile in <br /> modification of its 1989 Reclamation Plan for the above-referenced site, was held on June 26, <br /> 1997, during the regular meeting of the Mined Land Reclamation Board("the Board"), at 1313 <br /> Sherman Street, Room 318, Denver, CO 80203. <br /> PRELIMINARY MATTERS <br /> 1. The Board reviewed the Proposed Pre-Hearing Conference Order, considered the <br /> public objections raised and comments made to the Board and adopted the Proposed Pre-Hearing <br /> Conference Order with the following amendment: that under section III. "Issues To Be <br /> Considered", the positions of Issue 1 and Issue 2 be exchanged so that the=of Issue "2" now <br /> defines the First Issue to be considered at hearing, and the e&of Issue"1"now defines the <br /> Second Issue to be considered at hearing. <br /> 2. Regarding Issues 1 and 2, the Board reviewed the City of Boulder's request to <br /> continue these proceedings in order to include consideration of proposed changes to the berm, <br /> now styled as a Technical Revision, in conjunction with and as part of the Amendment. The <br /> Board heard and considered argument and testimony in support Q(continuance presented by <br /> Alan Boles, Esq. and Alan Taylor(on behalf of the City of Boulder and the County of Boulder); <br /> by Jane Bunin; and by Ruth Blackmore and argument and testimony ju opposition IQ continuance <br /> presented by Jeffrey Schwarz, Esq. and David Plummer(on behalf of Western Mobile) and by <br /> Assistant Attorney General Stephen Brown and Bruce Humphries (on behalf of the Division of <br /> Minerals and Geology). <br /> Having considered the written submissions and the arguments in support of and in <br /> opposition to the City of Boulder's request to continue these proceedings and following its public <br /> deliberation, the Board denied the request to continue and ordered the Formal Public Hearing on <br /> Amendment 002 to proceed. <br />
