As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated in the local <br />newspaper, all owners of record of surface and mineral lands, easement holders, and owners of record of surface lands <br />that are within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing <br />or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other qualified person. <br />The maps submitted to the Division were not signed. Please resubmit a signed copy of the maps. <br />It appears that the construction of a slurry wall around Longhorn and Shazkey's Lakes will cross a number of <br />gas/oil lines on the property. The operator will need to demonstrate that such gas/oil lines will be stable with <br />the construction of the proposed slurry walls in the form of an engineering evaluation, or provide a notarized <br />agreement from the owners of the structures and Platte Sand and Gravel, LLC. that meets the requirements of <br />Rule 6.4.19 and Section 34-32.5-115(4)(e), C.R.S. Please be aware that if any of the gas/oil lines need to be <br />relocated as a result of the mining and reclamation operation, then a notarized agreement between the operator <br />and the owner of the structure must be obtained prior to approval of the application. <br />Hope this helps.
