Mr. Carl Mount <br />Colorado Division Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Subject: James VanElla, Gold Basin Mine <br />Permit Number M-1992-045 / <br />Dear Mr. Mount: <br />~f~l~~l <br /> <br />/ 'SEC 212005 <br />~/ Uivisim~ ,,, ,~nu~rn~a ::nd GeoIn9Y <br />This letter is being submitted to inform the Division of Minerals and Geology that it is our <br />position that the subject mining operation located west of Granite in Chaffee County, Colorado, <br />does not have local land use approval for the proposed expanded mine operation. <br />The Chaffee County Commissioners approved a Special Land Use Permit in 1992 for the mine <br />operation, with the conditions that the operations be limited to a 3-acre portion of the parcel, and <br />the permit was to expire in October 1995 (see enclosed permit). Even if the permit had not <br />expired, Mr. VanElla would be required to apply to Chaffee County for a Mining Permit for the <br />expanded area. Many of Chaffee County's requirements are consistent with the state's <br />regulations; however we do have some additional requirements, and therefore object to <br />consideration by DMG on this application until Mr. VanElla has applied for a County permit. <br />Further, we request that any approval granted on this or any other mining permit application in <br />Chaffee County include a condition that Chaffee County Land Use approval be received prior to <br />beginning any operations or issuance of the permit. <br />We appreciate your assistance in this matter.
