r <br />-2- <br />CEASE AND DESIST ORDER <br /> <br />Based upon the foregoing Findings of Fact and Notice of Violation, a:~d <br />pursuant to the provisions of C.R.S. 34-32-123, the Board hereby orders you to: <br />Immediately cease and desist all mining operations. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Secure a mining or reclamation permit for the above-described mining <br />operation before October 16, 1991. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of $1,000.00 within 30 days of the signature date of this document. <br />This is based upon an assessment of $70.00 per day for 60 days of violation <br />prior to July 11, 1991, which totals $4,200.00 with $3,200.00 of this; penalty <br />suspended upon issuance of the required mining or reclamation permit before <br />October 16, 1991. <br />This Cease and Desist Order shall remain in effect until the required permit <br />is secured and the civil penalty paid. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with ,~udiciat review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />-rrf <br />Dated at Denver this~7 day of sus X99/. <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />DAVID L.
