Gl Dear Mr. Often: On October 1, 2004, the Division of Minerals and Geology received your request to place Mackey Mine, Permit No. M- 1984-013, into Temporary Cessation (Revision No. TC-1). On October 1, 2004, the Division notified you of the deficiencies of this request. Attention is called to the following from Rule 1.4.1(8): "An Applicant has sixty (60) days from such notice to submit all the necessary documents that the ice needs for an application to be considered filed. If at the end ofsixty (t50) day period, the application has not been determined to be filed with the Office, the Office shall deny the application and terminate the application file. If the ice denies and terminates the application file, the Office shall determine if the Applicant desires a return of the applications and shall provide the applications to the Applicant at no cost to the Office. Otherwise, the Office may dispose of all copies as appropriate. An Applicant may appeal such denial to the Board according to the provisions of Subsection 1.4.11. " To date, the required material has not been supplied to the Division. Therefore, the above request has been denied. You have the right to appeal the Division's decision under Rule 1.4.1 I.
