GRAND MESA PRClPERTIES COMPANY
P.O. Sox 3~
Delta, Colorado figi6
(303) e74.7~I
August 29, 1985
Jane H. Martin
Anaconda Minerals Company
555 Seventeenth Street
Denver, Colorado 80202
Dear Jane:
Thank you for your response to my letter of August 13th. I believe your
letter clears-up most of the questions we have regarding this matter.
I was quite surprised to Yearn you will be pulling pillars 1n three panels
in Section 20 during the next year to obtain subsidence data. As the surface
land owner of this Section we are concerned that your mining activities may
decrease the value of our Land. You nay not 6e aware that we awn conditional
decreed water rights on two springs in Section 19 and one spring in Section
20. We also consider the associated ponds and surface water conveyances.
natural or man-Wade, to 6e valuable assets inseparahle from the land.
Attached you will find the Consent Agreement signed on behalf of Grand Mesa
Properties Company. Please note the change we made to paragraph three of
tfie•Agreement: lie have approved the Consent Agreement even though it seems
premature to "assess, monitor and mitigate". Taking an inventory of the
structures. springs, ponds and water conveyances in the area of influence
of your three panels appears to he the first step Hest Elk should take after
being granted the right to enter the property.
As stated above, we are very concerned that surface subsidence may decrease
the value of our land. Please refer to Section 4.20.2 of the Regulations
of the Colorado Mined Land Reclamation Board for Coal Mining which 1s quoted
below.
4.20.2 Public Notice
The mining schedule shall be distributed 6y mail to all owners
of property and•resldents within the area above the underground
workings and ad,]acent areas. Each such person shall be notified
by mail at least six months prior to mining beneath his or
her property or residence. The notification shall contain,
in minimum:
(1) Identification of specific areas in which mining
will take place;
(2) Oates of mining activities that could cause subsidence
and affect specific Structures; and
(3) Measures to be taken to prevent or control adverse
surface-effects.
