I believe your <br />letter clears-up most of the questions we have regarding this matter. <br />I was quite surprised to Yearn you will be pulling pillars 1n three panels <br />in Section 20 during the next year to obtain subsidence data. As the surface <br />land owner of this Section we are concerned that your mining activities may <br />decrease the value of our Land. You nay not 6e aware that we awn conditional <br />decreed water rights on two springs in Section 19 and one spring in Section <br />20. We also consider the associated ponds and surface water conveyances. <br />natural or man-Wade, to 6e valuable assets inseparahle from the land. <br />Attached you will find the Consent Agreement signed on behalf of Grand Mesa <br />Properties Company. Please note the change we made to paragraph three of <br />tfie•Agreement: lie have approved the Consent Agreement even though it seems <br />premature to "assess, monitor and mitigate". Taking an inventory of the <br />structures. springs, ponds and water conveyances in the area of influence <br />of your three panels appears to he the first step Hest Elk should take after <br />being granted the right to enter the property. <br />As stated above, we are very concerned that surface subsidence may decrease <br />the value of our land. Please refer to Section 4.20.2 of the Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining which 1s quoted <br />below. <br />4.20.2 Public Notice <br />The mining schedule shall be distributed 6y mail to all owners <br />of property and•resldents within the area above the underground <br />workings and ad,]acent areas. Each such person shall be notified <br />by mail at least six months prior to mining beneath his or <br />her property or residence. The notification shall contain, <br />in minimum: <br />(1) Identification of specific areas in which mining <br />will take place; <br />(2) Oates of mining activities that could cause subsidence <br />and affect specific Structures; and <br />(3) Measures to be taken to prevent or control adverse <br />surface-effects. <br />
