ENVIRONMENT, INC. <br />AUOU5T 1 2, 2004 <br />PAGE 3 <br />proposed plan advanced in the adequacy response letter dated <br />3/26/01, item 38 will be used. <br />The following text is a copy of that response. <br />It does appear that PS&G will need to leave an additional 75 foot sough area from what ever <br />prescribed setback they need. I.e. if the setback is 25 feet the total would be IOOfeet marked <br />on the ground, if it is SO feet then IZS feet would have to be left. To avoid a expensive drilling <br />program, PS&G rnuld use ti0 feet at the depth to shale and not mine within 75 feet of the <br />setback umil they know the depth of the deposit. Then if it is shallower than 60 feet the limit <br />would be reestablish and mining could move closer to the structure. It is still to PS&G's <br />advantage to acquire an agreement that albws mining closer than this limit, so if agreements <br />are reached they will be submitted to the Division. <br />In leu of a signed agreement, Platte Sand & Gravel LLC will commit to establishing the mining limits <br />on the perimeter as mining advance thru a lake area. In each area, the formula used will he: sETatcx <br />D/ST,INCE t 75 FEET = D/STANCE TO PEOTECTIiD S7RUCITIRE <br />6. We are still awaiting copies of the agreements and will <br />submit them as soon as they are available. <br />7. I concur with this analysis, I had not looked at it that <br />way. The utilities in question are gaslines so the nota- <br />rized agreements or surface use agreements will suffice.
