Page 3 <br />SCC <br />10/28/04 <br />year; however, SCC further states that weather and labor contingencies may not allow all projects <br />to be completed. The Division does have some concerns with this statement. The Division staff <br />has been working closely with SCC to set forth a backfilling and grading schedule for each mine. <br />Most recently, revised schedules have been included in Seneca II-W PR-4 and Yoast TR-25. <br />These revisions address the backfilling schedules for the Yoast Neck Pit, Yoast south pit, Seneca <br />11-W "A" pit, and the Seneca II-W south pit. Each of these areas is to be backfilled and graded by <br />December 31, 2004. Based on the October inspections, it appears that all backfilling and grading <br />commitments will be achieved. If the grading is not completed, the DMG may enforce the <br />approved schedules set forth in the permits regardless of weather or labor contingencies. <br />The topsoiling/seeding schedules do include contingencies for weather. When final grade is <br />accomplished during spring or summer months, SCC has committed to and the DMG has <br />approved topsoil to be distributed in the fall. However, the permit does allow topsoil <br />redistribution the following year after final grading if weather prevents topsoiling in the fall. <br />Therefore, any areas graded during the fall of 2004 that are not topsoiled in 2004, must be <br />topsoiled and seeded in 2005. <br />Completion of the postmine drainage channels at Seneca II-W "A" pit and at Seneca II are subject <br />to approved designs that are currently under review. TR-45 at Seneca II-W addresses the "A" pit <br />channels and TR-36 addresses many of the channels at Seneca H. SCC has constructed many of <br />these channels prior to design approval by the Division. All postmine channels will be field <br />verified by the Division upon completion for compliance with approved plans. The field checks <br />will most likely be conducted during 2005. <br />Slide remediation at the Seneca [[-W Mine at the "A" Pit highwall and in Pond 16A has been <br />addressed in the recently submitted TR-45. The Division has not reviewed this revision yet. <br />Other Compliance Related Projects <br />SCC has identified several other compliance projects to be addressed at each mine site. Many of <br />the items SCC lists in this section correspond with other permitting and/or reclamation projects. <br />SCC addresses the weed control problem at Seneca II. The Division suggests that the same <br />program for inventorying, weed spraying and submittal of the Routt County Weed Control Plan <br />apply to the Seneca II-W and Yoast Mines as well. <br />At Seneca II, SCC addressed the Division's comment regarding rill and gully repair. However, it <br />is not stated where the additional work will be completed. The erosion that is occurring around <br />[he shrub establishment area should be addressed and repaired. <br />At Yoast, SCC did not address the Division's comment regarding the slide at Pond 012. SCC has <br />been requested to re-grade the area above Pond 012 to no steeper than 3:1. In addition, during <br />Mike Boulay's recent inspection it was noted that the survey stakes placed at the toe of the slide <br />above Pond 012 have been damaged or knocked down. SCC should replace these and continue to <br />monitor and report any new movement at the slide to the Division. <br />
