Cattany <br />Division Director <br />Hayden, CO 81639 Natural Resource Trustee <br />Re: Reclamation and Permit Compliance Status <br />Seneca Coal Company <br />Dear Mr. Kitchen: <br />In the Division of Minerals and Geology (Division) letter of October 22, 2004, DMG committed <br />to provide a detailed response to Seneca Coal Company's (SCC) October 7 letter following <br />completion of the October inspections. These site inspections were completed on October 18-19 <br />at the Yoast and Seneca [I Mines, and on October 26-27 at the Seneca II-W Mine. <br />Additionally, in our meeting with representatives of SCC today, additional discussions regarding <br />the status of the Seneca Mines was discussed. This letter addresses the items in your October 22 <br />letter as updated in our meeting today and also summarizes the reclamation projects based on the <br />Division's October inspections. <br />Permitting Tasks and Schedule <br />SCC identified several outstanding and upcoming permitting actions. The Division agrees with <br />the priorities as set forth in your letter for the most part. Two items were not included that the <br />Division feels are worthy of mention. The Division issued a proposed decision for Yoast TR-25 <br />on October 6, 2004. TR-25 includes a revised backfilling and grading schedule that is now part <br />of the approved Yoast permit. Seneca 11-W PR-4 was not included on SCC's list. The Division <br />provided a draft findings document to SCC on October 18. However, we are waiting for the legal <br />right of entry documentation before we can propose a decision. In our meeting today, SCC stated <br />that right of entry information would be provided in the next couple of days. <br />SCC discussed several upcoming changes at both the Seneca II-W and Yoast Mines in the <br />meeting today. The Division recognizes that the plans approved in TR-25 and PR-4 revisions are <br />subject to future changes in the mining and reclamation plans at the Yoast and Seneca II-W <br />Mines. <br />The following table provides a summary of the permitting tasks the Division is tracking.
