Dear Mr. Goemmer:
On April 27, 1994, the Colorado Mined Land Reclamation Board found
you to be in violation of C.R.S. 34-32-116(7)h for damaging land
outside of your permitted affected land boundary. You have chosen
to satisfy Board ordered corrective actions by reclaiming some land
affected outside of your permit boundary and adding other land to
increase your perm'lt area to 9.9 acres. This arrangement was
interpreted by the Director to satisfy the intent of ordered
corrective actions.
The Division has reviewed your amendment application which is
primarily a survey of an area which the Division believes is
intended to be your new permit boundary. Following is a list of
adequacy concerns rc;garding your application. Please answer these
concerns by July 27, 1994 or request a later decision date to avoid
denial of your application.
You have submitted a revised Exhibit A that provides a legal
description of the area you intend to include in the amended
permit, however you have not provided a new Exhibit E Mine
Plan and Reclamation Plan Map.
Below is a list of items that are necessary for this map.
Please prepare a map at a scale no smaller than 1 inch equals
50 feet. Provide a response to each item that is not
completely an:;wered by the original permit. Also, show on
your map(s) that portion of the area disturbed outside of your
original permit boundary that you have chosen to reclaim to
mitigate the corrective action ordered by the Board.
Exhibit E - Maw
You must provide a map that clearly describes the features
associated with the mining plan and the components of the
reclamation plan. You may want to include one map for the
mine plan and one map for the reclamation plan. The map(s)
