RE: Ellison Mine, DMG Reclamation Permit No. M-78-342, status of enforcement action.
Dear I\4r. Baldwin:
As you kno\v, the Formal Public Hearing for the enforcement action regarding failure to provide
adequate financial \varranty has been continued to the February 25-26, 1998 monthly Board
Meeting. The hearing will be held in Room 318 of 13 ] 3 Sherman Street, Dem~er, Colorado,
beginning at 9:00 a. m. or as soon thereafter as the matter can be considered.
In order to resolve this enforcement action, the current state reclamation permit holder (Ryan,
Ltd.) will need to complete one of the following options prior to the scheduled hearing date:
1) Provide to the Colorado Division of Minerals and Geology ("DMG") an acceptable
financial warranty in the amount of $10,70.00. The form of the financial warranty
instrument must fully conform with one of the various types of bond instruments currently
acceptable to the DMG, namely: a) Check for Deposit itt State Treasury; b) Certificate of
Deposit; c) Irrevocable Letter of Credit; or d) Corporate Surety. IIt addition, the financial
warranty must be submitted along \vith properly filled out and executed DMG bond forms
for the type of bond instrument selected. Also, the financial +varranty must be submitted
to, reviewed, and accepted by the DI\4G prior to the date of the hearing. In order to
provide DMG staff with sufficient time to revie\v the financial \varranty submittal, you will
need to submit the financial warranty materials several daLS prior to the schedtded hearing

to obtain the appropriate bond forms.
In the event the D)\4G permit holder wishes to pursue having the DMG accept a Dept. of
Energy ("DOE") bond in lieu of a DMG bond, the permit holder will need to provide to
the DMG, prior to the hearing, sufficient written verification from the DOE that: a) The
entire 9.0 acre area comprising the DMG reclamation permit is fully covered by a valid
DOE lease; b) The current DOE lease holder is the same entity as the D1\4G reclamation
permit holder; and c) The DOE financial warranty is valid and covers all reclamation
