SHELTON Director March 11, 1983 Mr. Tim Smith Cotter Corporation 9305 West Alameda Parkway Suite 201 Lakewood, Colorado 80226 Re: Schwartzwalder Mine - File No. 77-300 - Action Taken at the November 18, 1982 and February 24, 1983 Meetings of the Colorado Mined Land Reclamation Board ("the Board") Notice of Formal Public Hearing for the Board's Consideration .if Possible Violations and the Board's Consideration of Possible Civil Penalties Dear Mr. Smith: At the February 24, 1983 meeting of the Colorado Mined Land Reclamation Board ("the Board"), the Board was informed as to the status of the Schwartzwalder Mine Amendment and that the Board would consider this Amendment at the April 27-28, 1983 meeting. The hlined Land Reclamation Board set a formal public hearing date for consideration of the alle~3ed violations and possible civil penalties for the April 27, 1983 meeting as further described as follows: Pursuant to the authority vested in the Mined Land Reclamation Board ("the Board") pursuant to C.R.S. 1973, 34-32-124(1), the Board at its meeting of November 18, 1982, at which your representative was present and did participate, after due consideration did find reason to believe that certain provisions of permit No. 77-300, issued to the Cotter Corporation, have been violated. The provisions alleged to have been violated are: a) Exhibit A, concerniny the temporary waste rock handling area, of the application approved by the Board on August 23, 1478; b) Exhibit E, concerning uranium content of the waste dump, of the application approved by the Board on August 23, 1978; and c) Exhibits D and E, concerning the mining and reclamation plans, of the application approved by the Board on August 23, 1978. 423 Centennial Building. 1313 Sherman Street Denver, Colorado 80203 Tel.
