Colorado 80538 lames s. tocnnead <br /> Executive Dveclar <br />RE: Sprague- Red Lyons Quarry; Permit No. M-81-0~7 <br />Michael R long <br /> Division Dveaor <br />Dear Neil & ]udy Sprague <br />On January 14, 1999, the Division of Minerals and Geology conducted an inspection of your operation and <br />found the following: <br />Material was pushed into an undisturbed canyon west of Steamboat Valley Road outside of the Quarry q2 permit <br />boundary. The disturbance extends 150 feet wide and 200 feet down the canyon, for a total disturbance of 0.33 <br />acres. Material was also pushed outside of [he permit boundary of Quarry k3 for a distance of 250 fee[ long and <br />a0 feet wide, for a total dismrbant:e of 0.2 acres. We believe this is in violation of 34-32.5-I 16(4)(i) of [he <br />Colorado revised Statutes, commonly referred to as the Colorado Land Reclamation Act for the Estrac[ion of <br />Construction Materials for failing [o protect areas outside of [he affected land from slides or damage during the <br />mitring and reclamation operations. <br />Therefore, we have reason to believe that a violation exists to Permit Number M-81-057 and to the Law, and <br />Have scheduled [his matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be Held during [he February 24-25. 1999 Board meeting for consideration of <br />possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning <br />at 9:00 a.m. or as soon thereafter as the matter can be considered. At [ha[ hearing you will have the opportunity <br />to be represented and heard. It will be reiterated that there is reason [o believe that you are in violation of the <br />provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in the <br />amount of $f00 to $1000 for each day of violation, and/or order the permit be suspended, modified, or revoked. <br />In addition, it may set the matter for Forfeiture of [he $5.220.00 financial warranty at a subsequent hearing.
