<br /> <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br /> <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: > DECLARATORY ORDER <br />Mi Vida Enterprises, Inc. and ) CONCERNING RECONSIDERATION <br />Colina Oro Molino, Inc. ) OF NOTICE OF VIOLATION M-92-021 <br />T0: Mi Vida Enterprises, Inc. and Colina Oro Molino, Inc. and ail other <br />persons engaged in or owning or controlling the following operation: <br />Cash Mine and Mill, Boulder County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. M1 Vida Enterprises, Inc. and Colina Oro Molino, Inc. are permitted to <br />conduct a mining operation under the terms of Permit M-83-141 located in <br />Section 12, Township 1N, Range 72W of the 6th P.M., in Boulder County, <br />Colorado. <br />2. The Mined Land Reclamation Board conducted a formal Public Hearing on <br />January 27, 1993 to consider a request for a declaratory order to reconsider <br />the civil penalty associated with NOV No. M-92-021 issued on Permit No. <br />M-83-141. <br />3. The Division of Minerals and Geology presented evidence at the Formal <br />Public Hearing on January 27, 1993, demonstrating that: <br />a. A signed stipulation by all relevant parties that transfers Permit <br />No. M-83-141 to Colina Oro Molino, Inc. and Mi Vida Enterprises, <br />Inc. as co-permittees was presented to the Board. (See Exhibit A <br />attached). <br />
