Catralry <br />Division Dinxtw <br />NaNral Resource TrusEae <br />Attached, please find comments from the United States Forest Service (USFS) regarding the conversion <br />application for the Lily Mine, Permit No. M-1987-028. in the letter, the USFS requests that the DMG not <br />allow Colorado Mazble Inc. to commence with the exploration and producfion of the mineral materials located <br />on National Forest System lands until adequate environmental analysis is completed, and the Plan of <br />Operation (POO) is approved. The Division concurs that the conversion application cannot be approved until <br />a POO is approved by the USFS. <br />As you are aware, the Division's decision date is set for April 12, 2006. However, due to a letter of objection <br />from Chaffee County and the need toconduct apre-operation inspection on site (as per Rule 3.2(7) and Rule <br />1.4.1(7)), the matter of approval or denial of the application is tentatively scheduled for the June 14-15, 2006 <br />hearing before the Mined Land Reclamation Board. In order to render a recommendation before the boazd, <br />the Division's recommendation date is set for May 19, 2006. <br />If Colorado Marble does not obtain a POO prior to this date, the Division will recommend to the Board that <br />the conversion application be denied. However, in accordance with Rule 1.4.1(9), Colorado Marble may <br />extend the review time and the decision date reset not to exceed 365 days from the date the application was <br />filed.
