.r • <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br /> <br />IN THE MATTER OF: ) NOTICE OF VIOLATION M-92-029 <br />Gold Hill Ventures and > AND <br />Colina Oro Molino, Inc. > CEASE AND DESIST ORDER <br />T0: Gold Hill Ventures and Colina Oro Molino, Inc. and all other persons <br />engaged in or owning or controlling the following operation: Cash Mine and <br />Mill, Boulder County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. Gold Hill Ventures and Colina Oro Molino, Inc. is permitted to conduct a <br />mining and milling operation under the terms of Permit M-83-141 located in <br />Boulder County, Section 12, Township 1N, Range 72W of the 6th P.M., in Boulder <br />County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />May 2B, 1992 to consider possible violation of the terms of Permit M-83-141 <br />and C.R.S. 34-32-101 et seg' <br />3. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on May 28, 1992, demonstrating that: <br />The co-operators failed to use the permitted water pumping and <br />utilization scheme. <br />2. The co-operators failed to provide the Division with a detailed water <br />pumping and utilization scheme which included a monitoring plan in <br />the form of a technical revision or amendment from 11/26/91 to <br />5/22/92. <br />
