The <br />conclusion of the landslide study was that the field evidence does not indicate a causal relationship between the <br />Edwards Mine portal water discharge and the subject landslide. The water study reveals that the Edwards Mine <br />portal water discharge does not originate from the West Elk Mine fault related water which comprises the <br />majority of the water in the NW Panels sealed sump. MCC does not represent that these studies address all issues <br />of the West Elk Mine or Bear No. 3 Mine slope stability or probable hydrologic consequences; however, these <br />studies clearly show that the allegations of Notice of Violation (NOV) No. CV-97-022 are unfounded.
