• <br />Mi Lutes, May 21-28, 1992 <br />DRAFT <br />Subject To Board Approval 48 <br />It was MOVED that the Board follow the Staff's recommendations and find <br />the operator in violation for failure to contain tailings in the <br />tailings impoundment, order the cease and desist order to remain in <br />effect until the Division is satisfied that corrective have been <br />completed, order the corrective actions recommended by the Division and <br />order that whatever technical revisions or amendments required 'be <br />submitted by the operator, in order to include any land outside the <br />permit area potentially disturbed by any conveyance or transfer of <br />water or tailings, with required plans and applications to be submitted <br />to the Division prior to the June 1992 Board Meeting, with an update to <br />be provided by the Division at that time. SECONDED AND PASSED <br />UNANIMOUSLY (Cooley, Stewart, Danielson, Danni and Cattany); <br />Kraeger-Rovey and Jouflas not present for the vote. <br />It was MOVED that the Board accept the Divivion's recommendation and <br />assess a civil penalty at the rate of $135 per day for 42 days of <br />violation or $5,670, payable within 30 days and, if the corrective <br />actions are not taken, revisit the matter of the civil penalty and <br />consider assessing an additional civil penalty beginning with the March <br />26, 1992 date. SECONDED. <br />It was MOVED that the Board amend ~;~e Motion to reduce the daily rate <br />of the civil penalty from $135 to $100 per day for 42 days of violation <br />for a total of $4,200. SECONDED AND PASSED UNANIMOUSLY (Cooley, <br />Stewart, Danielson, Danni and Cattany); Kraeger-Rovey and Jouflas not <br />present for the vote. <br />It was noted that if the corrective actions are not met, the Board <br />would consider this a matter of gross negligence and consider a civil <br />penalty at the $135 per day rate. <br />The Motion was PASSED UNANIMOUSLY (Cooley, Stewart, Danielson, Danni <br />and Cattany); Kraeger-Rovey and Jouflas not present for the vote. <br />33.
