Consideration of a possible notice of <br />violation, cease and desist order, corrective actions and civil <br />penalties for three possible violations for failure to comply with <br />conditions of a permit as follows: 1) failure to use the permitted <br />water pumping and utilization scheme as described `n the permit for the <br />mill operation; 2) failure to contain tailings in railings impoundment <br />and 3) faiiure to repair rips in tailings pond liner using the method <br />approved in the permit and failure to prevent additional punctures <br />(continued from the April 1992 Board Meeting). <br />Staff noted that although expected, the operators were not present for <br />this portion of the hearing. <br />Staff presented EXHIBIT A, a chronology of this matter, and EXHIBIT B, <br />a presentation form in reference to possible violation 3, failure to <br />repair rips in the tailings pond liner using the method approved in the <br />permit and failure to prevent additional punctures, Staff said that as <br />of the May 22, 1992 inspection, all of the (80) holes in the liner had <br />been repaired. Staff recommended the Board assess a civil penalty in <br />the amount of $165 per day for 123 days of violation or 520,295. Staff <br />recommended that the Board suspend the civil penalty and the violation, <br />because the operator had completed the corrective action. <br />It was MOVED that the Board find the operator in violation as <br />recommended by the Staff, not issue an additional cease and desist <br />order, accept the corrective action of patching the rips and holes and, <br />to insure that an adequate monitoring plan is in place, direct that <br />Division to use its discretion in establishing a monitoring plan. <br />SECONDED AND PASSED UNANIMOUSLY (Cooley, Jouflas, Stewart, Danielson, <br />Danni and Cattany); Kraeger-Rovey not present for the vote. <br />It was MOVED that the Board suspend all, but 51,000 of the civil <br />penalty. SECOND AND PASSED 5 for (Jouflas, Stewart, Danielson, Danni <br />and Cattany); 1 against (Cooley); Kraeger-Rovey not present for the <br />vote. <br />Staff presented EXHIBIT C, a presentation form, and discussed the 1st <br />possible violation, failure to use the permitted water pumping and <br />utilization scheme as described in the permit for the mill operation, <br />referencing the layout of the mine site. Staff said the permit <br />requires water to be obtained from a water share on Left Hand Creek. <br />However, Staff said the operator operated the mill without using the <br />system; water was pumped from the Cash Mine and the Hazel A, <br />unpermitted sources. <br />
