NOV C-91-036 <br />Southfield Mine <br />Failure to notify surface owners prior to undermining their <br />property. <br />HISTORY: No violations in the past 12 months. <br />SERIOUSNESS: Although surface owners were not notified of <br />undermining in compliance with Rule 4.20.2, the owners had granted <br />access to their property during the permitting process and the <br />subsidence plan in the mine permit commits the operator to <br />repairing any damages which might result from subsidence. <br />Therefore, the seriousness of this violation is viewed as low. <br />FAULT: The operator was negligent in not providing the notice of <br />undermining required by the regulations. <br />GOOD FAITH: Good faith is not applicable since the violation has <br />not yet been abated. <br />c:\wp51\lpr\1r25h <br />
