a ~~ /RECEiVED <br />bd ~ -h/ JUN 2 5 2004 <br />/~ Division of Minerals & Gaolopy <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER REGARDING PERMIT <br />REVOCATION AND FORFEITURE OF FINANCIAL WARRANTY <br />IN THE MATTER OF PABLO VASQUEZ, FILE NUMBER M-1992-108 ~ <br />THIS MATTER came before the Mined Land Reclamation Boazd ("Board") on May <br />26, 2004 in Denver, Colorado for a hearing to consider the request of the Division of <br />Minerals and Geology ("Division") for an order revoking a Section 110c permit and <br />forfeiting the applicable financial warranty for failure to pay the annual fee and civil <br />penalties. The file number in this matter is M-1992-108. James Dupler appeared on behalf <br />of the Division. There were no appeazances on behalf of Pablo Vasquez ("Permittee"). <br />The Board, having considered the Division's presentation and having been otherwise <br />fully informed of the facts in this matter, hereby enters the following findings of fact, <br />conclusions of law and order: <br />1. In 1992, the Board approved the Permittee's application for a Section 110c reclamation <br />permit fora 6.5-acre site located in Section 1, Township 3 North, Range 71 West, 6`h <br />Principal Meridian, Boulder County, Colorado. The location is referred to as the Bad Boy <br />Stone site. The Permittee submitted bonds totaling $5,300.00 to the Division as a financial <br />warranty to secure reclamation of the site <br />2. The Permittee failed to submit an annual report and failed to submit an annual fee of <br />$281.00 to the Division by February 3, 2004. On Februazy 24, 2004, the Division <br />inspected the site. On April 8, 2004, the Division issued violation MV-2004-018 for failure <br />to submit an annual report and pay the annual fee. The Division also assessed a civil <br />penalty of $281.00. On April 8, 2004, the Division notified the Permittee that unless the <br />
