.-, fi <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology (DMG) has issued a proposed decision <br />to approve a partial bond release for the Marr Strip Mine, permit number C-80-006. <br />The Marr Strip Mine is permitted to and owned and operated by Kerr Coal Company. <br />A request for 60% release of the liability bond amount applicable to the 720 Pit area <br />was submitted by Kerr Coal Company for successful completion of backfilling, regrading <br />and drainage control in accordance with the approved reclamation plan for the mine site. <br />The original bond release request covered the Pit 1 and 720 Pit areas and was submitted <br />March 18, 1994. On May 15, 1995, the bond release request was modified to include <br />only the 720 Pit area. The DMG proposes to release $2,171,216.00 (60%) of the <br />$3,618,694.00 bond amount applicable to the 720 Pit area. The DMG's proposed <br />decision will retain $1,447,478.00 for reclamation liability remaining at the 720 Pit area <br />and $891,950.00 for reclamation liability remaining at other locations at the mine site. <br />The Marr Strip Mine is located in Jackson County, approximately ten (10) miles east of <br />Walden, Colorado, on County Road 12. The 720 Pit area is located in portions of <br />section 35, T. 9 N., R. 78 W. and section 2, T. 8 N., R. 78 W., of the 6th Principal <br />Meridian and may be found on the U.S.G.S. 7.5 minute quadrangle maps titled Johnny <br />Moore Mountain and Gould NW. <br />Copies of the proposed decision are available for review at the office of the DMG, 1313 <br />Sherman Street, Room 215, Denver, CO 80203, and at the Jackson County Courthouse <br />in Walden, Colorado. Any person with a valid legal interest which might be adversely <br />affected by the proposed decision, or any responsible officer or head of any Federal, <br />State, or local government agency which has jurisdiction by law or special expertise with <br />respect to any environmental, social, or economic impact involved in the operation, or is <br />authorized to develop and enforce environmental standards with respect to such <br />operations, may request an adjudicatory hearing. The request for the adjudicatory <br />hearing must be made in writing within thirty (30) days of the first publication of this <br />notice, and must state with specificity the reasons why the hearing is being requested. <br />
