Hernandez, Senior Reclamation Specialist~l"~ <br />RE: Abatement Date Extension, Western Fuels-Colorado, <br />New Horizon Mine, Permit No. C-81-008, NOV No. C-92-024 <br />The Division staff requests your approval of an extension of an NOV <br />abatement deadline to beyond the statutory 90-day timeframe. We <br />wish to provide Western Fuels-Colorado, the new operator of this <br />mine, an additional 90 days for both the designing of secondary <br />sedimention pond spillways and their installation. The original <br />deadline, established for Western Fuels-Colorado, was set for <br />November 24, 1992. The Division requests the new deadline be <br />extended to January 23, 1993. <br />The following is a history of the series of events leading up to <br />this request: <br />1. On May 15, 1991, the Division sent notices to all coal mine <br />permittees and the Colorado Mining Association of changes to <br />the Colorado Coal Mining regulations regarding construction of <br />separate primary and emergency spillways within all <br />sedimentation ponds (copy enclosed). This notice required all <br />operations to be in compliance by September 1, 1991. <br />2. On August 18, 1991, Peabody Coal Company submitted Technical <br />Revision TR-OS to its permit, addressing its proposals for <br />compliance with this rule change. <br />3. Over the next six months, the Division sent adequacy review <br />letters to Peabody Coal Company, identifying deficiencies with <br />the submitted proposal. <br />4. On March 12, 1992, the Division received a request to transfer <br />Permit No. C-81-008 from Peabody Coal Company to Western <br />Fuels-Colorado. This request was subsequently approved on <br />May 15, 1992. The Division continued addressing TR-OS with <br />the new operator. <br />
