? ~. <br />-~- <br />REVISED ORDER <br />Based upon the above findings of fact and conclusions of la~o, the Board ORDERS that: <br />1. Colorado City Metropolitan District is hereby found to be IN VIOLATION of Section 34-32.~ <br />l23(2), C.R.S. for conducting minine operations without a permit. <br />2. Colorado City Metropolitan District is hereby ORDERED to Cease and Desist from all mining <br />activities outside the approved permit boundary except reclamation activities, until the conversion <br />application currently being reviewed by the Division is approved. <br />3. Colorado City Metropolitan District is hereby ORDERED to obtain approval of the pending 110 <br />Limited Impact to 112 Regulaz permit conversion application by Lune 20, 2000. <br />4. Colorado City Metropolitan District is hereby assessed a Civil Penalty of $1,000.00 per day for 48 <br />days of v" totaling $48,000.00, pursuant to section 34-32.5-123(2), C.R.S. Of the total civil <br />penalty $ ~~~ is suspended in recognition of Colorado City Metropolitan District's efforts to address <br />the violation in a timely fashion. The unsuspended portion of the Civil Penalty, $750.00 shall be paid <br />within 30 days of the signature date of this order. <br />The rights and obligations of recipients of Notices of Violation/Cease and Desist Order aze described in <br />the Colorado Mined Land Reclamation Act for the Extraction of Construction Materials, Section 34-32.5- <br />101 et seg.
