Mr. Joseph Dudash
May 28, 1993
Page 2
cleaned and upgraded as per the requirements. An MR has been
submitted for Ditch 14. An extension for the cleaning of Ditch 17
is requested due to the wet nature of the ditch. Culverts 4 and 5
have been cleaned, culvert 7 has been removed, and an extension for
cleaning of the vent shaft access road culvert is requested.
NOV C-93-019 - Topsoil stockpile No. 4 has been fenced to eliminate
grazing. A extension is requested for the stockpile located along
the access road to the vent shaft.
NOV C-93-069 - An extension for the replacement of the Pond 003
discharge pipe is requested. Repair work for Ditches 4, 5, 8, and
20 has been completed. An extension for repair of Ditch 7 is
requested.
NOV C-93-070 - Culvert 3 has been replaced with a designed 24 inch
culvert. Culvert 5 has been supplemented with a Reno Type Mattress
lined ditch of the type B cross section. An extension for sizing
Culvert 6 is requested. The culvert in Ciruela Canyon was
installed with the railroad and therefore not part of the sediment
control system for the mine.
Basin Resources is requesting an extension of the abatement
deadline for the above violations to June 11, 1993. The reason for
this extension request is due to a number of factors which include
the following:
1. Extremely wet weather over the past 60 days has prevented
earth work for many of the ditches and culverts. This weather has
also necessitated duplication of work which was conducted and than
needed to be reworked (e.g. cleaning of ditches).
2. Many of the items which need to be completed are extensive
activities and require significant effort and or specific
equipment. As these resources have been committed on active
projects which must be conducted under the NOVs, other NOV projects
are waiting to be completed.
3. The volume of work necessary to abate these NOVs is extensive
and has surpassed the ability of Basin's resources. As a result,
contractors have been hired to complete the work to the extent
possible. That is, there are only a few contractors in the area
which have the necessary insurance, equipment and experience to
complete the work. Basin is committed to utilize all of its
resources and qualified contractors to complete the abatement
activities as soon as possible.
4. One of Basin's key engineering staff left the operation in mid
May 1993 and is no longer available to complete the activities
which were assigned to him.
